PARENTAL RESPONSIBILITY

The term “parental responsibility” essentially refers to decision-making by parents for children.  It does not refer to how much time children spend with each parent.

Under the Family Law Act, there is a presumption that both parents of a child will have “equal shared parental responsibility” for that child.  This means that parents must make decisions about “major long-term issues” for children jointly.  This may include decisions about education, health, religion and/or proposed relocations.  It requires parents to consult with one another and make a genuine effort to come to a joint decision.

“Equal shared parental responsibility” may not apply in certain circumstances, such as where there is serious family violence or high parental conflict.
